Sandbagger Invitational Waiver

 

This is a handicapped event of motivated individuals gathered for a day of exertion and fun.

Anyone having anything to do with this event IS NOT RESPONSIBLE FOR YOUR SAFETY OR WELL BEING. We cannot stress this strongly enough… YOU ARE RESPONSIBLE FOR YOU! 

Sandbagger Invitational is a non-stop, self supported, athletic event that utilizes the lakes, trails, gravel and dirt roads of rural Kansas. 

Each participant is considered to be on a private excursion and remains solely responsible for any accidents in which he or she may be involved. No responsibility can be accepted for participants becoming lost, stranded, injured… or worse.

Participants will be responsible for printing their own set of course maps and/or cue sheets prior to the event. These documents will be the rider’s primary means of navigation. In addition, the course may have a limited number of course markings to reassure participants they are on route. DO NOT RELY ON COURSE MARKINGS FOR NAVIGATION. USE THE MAP AND/OR CUE SHEETS!!! Participants may load the route into their GPS prior to the event, to assist in navigation.

The primary route must be followed at all times. No short cuts or alternate routes are permitted. The course may be altered in the event of inclement weather, or other unforeseeable circumstance. Should this occur, participants will be sufficiently advised.

Participants must wear a properly approved helmet while operating their bicycle.

Participants must obey all city, county, and state laws, and “Rules of the Road”.

Drafting on another event participant is allowed.

You are completely on your own. Use your head. Watch for and yield to traffic. All roads are open to public traffic.

I acknowledge that participating in the Sandbagger Invitational is an extreme test of a person’s physical and mental limits and such participation poses potential risks of serious bodily injury, death, or property damage. With full understanding of the risks I am taking, I HEREBY ASSUME ALL THE RISKS OF PARTICIPATING IN THE EVENT and agree to the following:

I hereby attest that I am in good health and my physical condition has been verified by a licensed medical doctor and, furthermore the licensed medical doctor has been advised that I intend to participate in these activities.

In consideration of participating, I hereby take the following action for myself, my executors, administrators, heirs, next of kin, successors and assigns, or anyone else who might claim or sue on my behalf: (a) I WAIVE, RELEASE, AND DISCHARGE from any and all claims, costs, or liabilities for death, personal injury or damages of any kind, which arise out of or relate to my participating, THE FOLLOWING PERSONS OR ENTITIES:  Anyone having anything to do with this event. (b) I AGREE NOT TO SUE anyone for any of the claims, costs or liabilities that I have waived, released or discharged herein; and (c) I INDEMNIFY, DEFEND, and HOLD HARMLESS the persons or entities mentioned above from any claims made or liabilities assessed against them as a result of my actions except those resulting from the willful acts or gross negligence of entities mentioned above.

I AFFIRM THAT I HAVE READ THIS DOCUMENT AND UNDERSTAND ITS CONTENTS.  I UNDERSTAND THAT BY ACCEPTING THE TERMS OF THIS DOCUMENT I AM WAIVING SIGNIFICANT LEGAL RIGHTS AND AM INCURRING SIGNIFICANT LEGAL LIABILITIES.  I HAVE BEEN SPECIFICALLY ADVISED TO CONSULT WITH AN ATTORNEY IF I DO NOT UNDERSTAND ANY PORTION OF THIS RELEASE AND AGREEMENT.
